Legal Recognition of the National Institute for the History of the Liberation Movement in Italy
The Chamber of Deputies and the Senate of the Republic approved; The President of the Republic: Enact the following law:
Art. 1
The legal status of L'Istituto nazionale per la storia del movimento di liberazione in Italia is recognized.
Art. 2
It proposes to ensure the most complete and ordered documentation of that movement from its antifascist origins to the time of the Liberation; to promote historical study of it and knowledge of it through periodicals and other scientific publications, such as those of conferences and other study initiatives. The Institute is placed under the supervision of the Minister of Public Education.
Art. 3
Regional, provincial, and local historic Institutes that perform similar activities of documentation and study in the same field and historical bodies of a non-territorial nature with a similar scope are members of the national Institute. The national Institute judges their acceptance based on the norms provided in its charter.
Art. 4
The national Institute is supported by a General Council formed by representatives of the associated historic Institutes, representatives of the public Administration, and co-opted members. The charter determines the composition of representation by the Institutes and the degree of co-optation allowed. Three members respectively appointed by the ministries of public education (Academies and Libraries), the interior (State Archives), and defense (Historical Offices) will represent the public Administration.
Art. 5
The General Council nominates the governing organs of the Institute which consist of the Governing Council, the president, and the Board of Auditors. The auditors are appointed by the Office of the Prime Minister, by the Minister of Public Education, and by the principal financing bodies.
Art. 6
The associated Institutes must be formally constituted and have their own charter and autonomous management. It is their responsibility to preserve the documentation and bibliographic and museological material they have collected. They may be formed on a membership basis, provided that such is regulated according to precise statutory norms. Their scientific activity is subject to supervision by the national Institute, to which they must present an annual report and an accounting of contributions made to them.
Art. 7
The Ministers of Public Education and of the Interior (State Archives), on request from the national Institute, are authorized to assign staff, deemed particularly suited to specific jobs of a scientific and archival nature, by comando (a particular form of employment contract used by the Italian public administration in which one public body lends personnel to another for a defined period of time).
Art. 8
To the national Institute is granted as part of the State budget an annual contribution equivalent to 50 million lira. Such contribution will be provided by reducing section 2192 of the Treasury Ministry budget for the financial year 1966 by the same amount. Said contribution will be distributed proportionately among historical or archival activities, according to proportions which will be established by the annual budget forecast approved by the General Council and the Board of Auditors. The national Institute is subject to the control on subsidized bodies exercised by the Corte dei Conti according to the law of 21 March 1958, n.259.
Art. 9
The national Institute is required to present a report on its activities annually to the Minister of Public Education.
Art. 10 The charter of the national Institute, drawn up according to criteria set forth in the present statute, will be approved by decree of the Minister of Public Education.
